These Terms and Conditions are applicable to Couture India Show and is organized by Gem & Jewellery Information Centre having its registered office at A-95 Journal House Janta Colony Jaipur

APPLICATION REGISTRATION AND CONFIRMATION:
Application for acceptance as an Exhibitor for the Exhibition must be made by submitting a duly completed, signed, and stamped application form. Acceptance of the application and confirmation will be at the sole discretion of the Organisers.
1. ELIGIBILITY CRITERIA
The Exhibitor shall be the manufacturer with a production facility capable of handling order from retailers and must belong to one of the following categories:
a. Diamond Jewelry: Mass-produced, immaculate craftsmanship.
b. Gold Jewelry: Antique, gold fusion, lightweight designs.
c. Couture Jewelry: Designer and fusion jewelry with a mix of diamonds, gemstones, enameling, etc.
d. Mass-Produced Polki Jewelry: Closed or open settings.
e. Supporting Halls: Loose diamonds, gemstones, software, machinery, and service companies will be accommodated in supporting halls, registration halls, foyers, or pre-function areas.

The Organisers reserve the right to refuse any application that does not meet the Exhibition's standards and requirements.
2. EXHIBITION PARTICIPATION AND STALL ALLOCATION:

  • The registration application submitted to the Organiser shall be binding upon the Exhibitor /Co-Exhibitor. The Exhibitor agrees to accept the stall allocated to it.
  • The Director, CEO of the participating company, or in the case of sole proprietorships, the business owner, or one partner in the case of a partnership firm must be present at their stall for the entire duration of the Exhibition.
  • The Exhibitor is not permitted to exhibit outside of the allocated stall space or obstruct aisle areas emergency exits, or fire extinguishers.
  • The Organiser reserves the right to make changes to the allocated stall as necessary for the efficient layout and operation of the Exhibition.
  • Exhibitor's stall must be operated in accordance with all applicable legal conditions and administrative guidelines.
  • Exhibitors are not allowed to assign, sublet, or transfer their stall, in whole or in part, to another party. The Exhibitor shall not make the allocated stall space available to a third party without the prior consent of the Organiser.
  • The allocation of stall space shall be at the sole discretion of the Organiser and will be made based on technical factors related to the Exhibition. Exhibitors have no right to any particular position or size of stall, regardless of any particular positioning requests which may have been made on the application form.

3. DISPLAY GUIDELINES:

  • The Exhibitor must ensure that all the products showcased during the Exhibition meet the highest quality standards and comply with applicable laws and regulations regarding authenticity, quality, and origin. The Organiser has the right to instruct the Exhibitor to replace any product that does not meet the prescribed standards within 3 hours. Failure to comply may result in removal of the product or cessation of the Exhibitor's participation.
  • Exhibits must remain open and fully manned during Exhibition hours. No Exhibitor is allowed to dismantle their display or leave their stall unattended before the Exhibition has officially closed. The stall must be staffed and accessible to visitors throughout the Exhibition. Exhibitors are not permitted to access other stalls without prior permission from the respective Exhibitor.
  • Exhibitors shall only display products they manufacture, represent, or distribute and shall be approved by the Organiser prior to the Exhibition. The stall cannot be used to showcase the products of other parties without prior written consent from the Organiser and the concerned party. All exhibits must be presented professionally.
  • Exhibitors must ensure their stall and displays comply with the Exhibition’s rules regarding guidelines and safety. Exhibitors must submit their stall design for approval by the Organiser at least 30 days prior to the Exhibition.

4. EXHIBITOR GUIDELINES:

  • The Exhibitors are responsible for adhering to all fire and safety codes, and must follow the guidance given by any representative of the Exhibition.
  • No nails, screws or other fixtures may be driven into any part of the Premises including floors; nor may any part of the premises be damaged or disfigured in any way. Should any such damage occur, the Exhibitor responsible would be liable to hear and pay for any charges for damage or disfiguration done.
  • The use of audio/visual equipment, including monitors, projectors, and speakers, must comply with the Exhibition's guidelines to avoid disruptions to other Exhibitors and attendees.
  • The Exhibitor must submit any electrical or technical requirements to the Organisers well in advance. Unauthorized electrical work or modifications are prohibited.
  • Exhibitors must adhere to the Exhibition’s security guidelines. The Exhibitors should also secure valuable items, equipment, and products within their stalls.
  • Exhibitor is responsible for keeping their stalls clean and free of waste during the Exhibition. The Organiser will provide waste disposal services, but Exhibitors are expected to ensure that their stalls are kept in an orderly and hygienic condition. At the end of the Exhibition, Exhibitors must remove all materials, products, and waste from their stall area.
  • If a participant or stall allottee breaches any rules or conditions before the Exhibition, their allotment will be revoked, and the full participation fee will be forfeited.
  • Exhibitors should maintain professional conduct at all times. Exhibitors who violate rules during the Exhibition or are reported for misconduct Harassment, disruptive behavior, or actions that negatively impact the Exhibition will not be tolerated and will be prohibited from participating in future Exhibitions.

5. PAYMENT TERMS:

  • Exhibitors are required to pay the fee upon acceptance of the registration form as submitted. Payment must be made via the methods specified by the Organiser on the invoice. Failure to make payment by the due date may result in the cancellation of the Exhibitor’s participation, and the space may be reassigned to another applicant.
  • Any extra costs, such as electricity, special equipment, or services, should be paid by the Exhibitors in full.

6. EXHIBITION MODIFICATION AND CANCELLATION BY ORGANISER:

  • The Organiser reserves the right to cancel, postpone or reschedule the Exhibition, should circumstances require, without incurring any liability. The Organiser may also alter the Exhibition floor layout, change the site or location of an Exhibitor’s stand, or reallocate space as necessary. Exhibitors agree to accept such changes without objection.
  • In case of a date change, participants will be notified 07 days prior of the proposed dates. If the show is postponed within 30 days of the Exhibition, the participation fee will be fully adjusted to the next scheduled Exhibition. If the postponement occurs more than 30 days prior, participants are entitled to a full refund, provided they request it within 7 days of the announcement. Refunds will only be processed for companies that have not deducted TDS while sending advances.
  • In the case of postponement or alteration in the duration of the Exhibition, the specific terms and conditions of Exhibition shall be applicable to the new duration and hours of operation.

7. CANCELLATION BY EXHIBITOR:
If the Exhibitor wishes to withdraw, cancel or decides not to participate in the Exhibition, they must provide written notice to the Organiser, with proof of receipt. The total participation fees shall stand forfeited by the Organiser at its sole discretion. No claims for refunds on any account will be entertained by the organiser.

8. ADVERTISING AND PUBLICITY:

  • The Exhibitor is encouraged to promote their participation in the Exhibition using their own marketing channels (e.g., websites, social media, email newsletters). The Exhibitor may refer to their participation in the Exhibition in a manner that complies with these terms and conditions and does not mislead or confuse the public regarding the nature of the Exhibition.
  • Exhibitors are permitted to display advertisements, signage, and promotional materials within their designated stall space. with the Exhibition's code of conduct and do not include offensive content.
  • All such materials must be professional, aligned with the theme of the Exhibition, and approved by the Organisers before display. Any materials deemed inappropriate, offensive, or inconsistent with the Exhibition’s standards may be removed at the Organisers’ discretion.
  • The Exhibitors are prohibited from distributing advertisements, business cards, or printed materials related to the Organiser

9. LIABILTY AND LIMITATION OF LIABILITY:

  • The Organiser is not responsible for the Exhibitor’s indirect losses, including but not limited to loss of profits, loss of goodwill, etc. The Organiser shall not be liable for damage caused by visitors to the Exhibition or by other Exhibitors and persons acting on their behalf.
  • The Exhibitor is liable for any damage, including loss of or damage to goods, caused either by themselves or by any of their assistants, employees, invitees, associates at the Exhibition venue. The Exhibitor is also liable for any other damage arising from their failure to supervise the space allocated. The Organiser is not responsible for the Exhibitor's exhibited products. The Exhibitor agrees to indemnify and hold the Organiser harmless from any claims, damages, or legal actions arising from the Exhibitor or its representatives’ actions or omissions. The Organiser is not responsible for the Exhibitor’s exhibited property or for any loss, theft, or damage, nor for any damage arising from Exhibitions beyond the Organiser's control, including natural disasters or other force majeure circumstances.

10. INTELLECTUAL PROPERTY:

  • The Exhibitor acknowledges that all Intellectual Property Rights held by the Organiser, along with any goodwill associated with them, shall remain the sole property of the Organiser. Nothing mentioned herein grants the Exhibitor any license or right to use any of the Organiser's Intellectual Property Rights without the express prior written consent of the Organiser.
  • The Exhibitor agrees and consents to the use and reproduction by or on behalf of the Organiser (and its licensees) of the Exhibitor's name and logo in any audio, visual, and/or audio-visual or electronic recordings of the Exhibition. This includes use by all means and in all forms of media, whether now known or hereafter invented (including in connection with the Exhibition website), throughout the world, in perpetuity. Such use is for the purposes of advertising, merchandising, and publicity of the Exhibition, as well as for similar Exhibitions operated by the Organiser.
  • The Exhibitor agrees not to engage in any advertising, promotion, or publicity that infringes on intellectual property laws, misleads the public, or harms the reputation of the Exhibition or its Organisers. The Exhibitor hereby undertakes to ensure that exhibits comply with all design, trademark, copyright, patent or other laws and other requirements for protection of Intellectual Property.

11. NON- PARTICIPATION IN OTHER TRADE SHOWS:

  • Participating companies, along with their sister companies or affiliates, are strictly prohibited from taking part in any other trade shows or Exhibitions within 15 days prior to and 7 days following the proposed Exhibition Dates, across India. Any violation of this policy will be considered as a cancellation by the exhibitor, and the cancellation terms will be enforced.

12. INSURANCE:

  • Exhibitors must obtain appropriate insurance and provide copies to the Organisers, covering product damage, loss, and public liability during the Exhibition and in transit. The Organiser is not responsible for any loss, damage, injury, or risks due to Exhibitions beyond their control, such as natural disasters or force majeure. Exhibitors are responsible for securing their own insurance to cover all liabilities, including risks from Exhibition cancellation or abandonment.
  • In the event of cancellation by the Exhibitor, the Exhibitor agrees to indemnify the Organisers from any expenses, costs, claims, losses, or liabilities that the Organisers may incur as a result of the Exhibitor’s cancellation. This includes any charges, damages, or costs directly resulting from such cancellation.
  • The Organiser’s liability is strictly limited to the Exhibition and does not extend for the coverage of Exhibitors’ assets or liabilities, including any risks not addressed by the Exhibitor’s own insurance. Any insurance claim made should not affect the rights or responsibilities of the Organiser or any third party involved in the Exhibition

13. DANGEROUS MATERIALS AND EXHIBITS:
Exhibitors must comply with regulations regarding explosives and dangerous materials, as specified by the appropriate authorities. Any unapproved material or exhibit may be removed from the stall space by the Organiser if it does not comply with the relevant rules and regulations.

14. FIRE PRECAUTIONS:
All materials used in construction, displays, etc., must be in accordance with relevant rules and regulations and according to the authorities' standards. Exhibitors must follow any reasonable instructions from the authorities or Organisers to mitigate fire risks.

15. FORCE MAJEURE:
If the Exhibition is abandoned, cancelled, or suspended in whole or in part due to reasons beyond the Organisers' control, including but not limited to natural disasters, war, fire, national emergency, labour disputes, unavailability of Exhibition premises, changes in government or regulatory policies, government orders, epidemics, pandemics, public health emergencies, outbreaks of infectious diseases (including but not limited to COVID-19), lockdowns imposed by central or state governments, civil protests, demonstrations, road blockages, or any other Exhibition beyond the Organisers' control, the Organisers will not be liable for any claims, losses, or expenses incurred by the Exhibitor.

16. GOVERNING LAW AND JURISDICTION:
Any dispute arising out of or in connection with these terms and conditions, including those regarding their existence or validity, shall be resolved by the courts in India. The courts in shall have exclusive jurisdiction over any disputes related to the subject matter herein.

17. AMENDMENTS:
The Exhibition Organisers reserve the right to amend these terms and conditions at any time. Exhibitors will be notified of any changes in writing at least 15 days in advance.

18. COMPLAINTS:
Exhibitors’ complaints in relation to the Exhibitions and these terms and conditions should be made in writing and sent to Organiser without delay and not later than 10 days from the date of the Exhibition.

19. SEVERABILITY:
If one or more provisions of these terms and conditions are found invalid this shall not affect the rest of the provision’s validity.

20. ENTIRE AGREEMENT AND DISCREPANCIES:

  • The terms and conditions and any document referred to in these conduct the entire agreement between the Exhibitor and Organiser.
  • The terms and conditions prevail in case of any discrepancies between these and other agreements between the Parties.
